These Terms & Conditions of Use (“Terms”) are entered into by and between you and Somasynthesis Studios Inc., doing business as Competitive Advantage (“Competitive Advantage,” “Company,” “we,” “us,” or “our”).
These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, govern your use of competitivedge.com and any subdomains (the “Website”), including all materials, resources, information, products, and services available on or through the Website, whether as a guest or registered user.
Your access to and use of the Website is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, and others who access or use the Website.

Children under age 13 should not independently submit personal information through the Website, including through quizzes, contact forms, email subscriptions, purchases, or other features that collect personal information.

Definitions
Mental Training refers to the educational process of developing and practicing mental skills that can support performance, including skills related to confidence, concentration, managing pressure, responding to mistakes and setbacks, motivation, visualization, and other aspects of performance.
Mental Performance refers to the mental, emotional, and physiological factors that can influence an individual’s ability to perform, learn, compete, and respond effectively to the demands of sport and other performance environments.
Peak Performance refers to an individual’s ability to access and perform closer to their capabilities under the demands of practice, competition, or other performance situations. Use of the term “peak performance” does not represent or guarantee any particular performance outcome or level of achievement.
Coaching refers to the educational, collaborative, and goal-oriented services provided by Competitive Advantage to help individuals develop awareness, skills, strategies, and resources related to performance. Coaching may include discussion, education, exercises, mental training techniques, and other performance-based approaches. Coaching is not psychotherapy, psychological treatment, medical treatment, or another licensed healthcare service.
Educational and Mental Performance Resources
Educational and Informational Purposes
The information contained on the Website and the resources, information, articles, blog posts, audio programs, videos, quizzes, assessments, exercises, downloads, products, and other materials available through the Website, whether free or paid (collectively, the “Resources”), are provided for educational and informational purposes.
Not Medical or Mental Health Treatment
Competitive Advantage provides mental performance training, coaching, educational resources, consultation, and related services.
Information provided through the Website and Resources is not intended to diagnose, treat, cure, or prevent any medical or mental health condition and should not be understood or used as a substitute for medical advice, psychological or psychiatric diagnosis or treatment, counseling, psychotherapy, or other care provided by a qualified healthcare or mental health professional.
Individuals should seek appropriate professional care when medical, psychological, psychiatric, or other healthcare needs arise.
Quizzes, assessments, exercises, and other self-reflective tools available through Competitive Advantage are educational in nature and are not clinical assessments, diagnostic tools, or substitutes for evaluation by an appropriately qualified professional.
No Professional-Client Relationship Through Website Use
Your use of the Website, including implementation of suggestions or use of Resources available through the Website, does not by itself create a coaching, professional-client, healthcare-provider, therapist-client, or other professional relationship between you and Competitive Advantage or any of its owners, employees, contractors, or professionals.
A coaching, consulting, or other service relationship may be established separately when you enter into an applicable agreement or arrangement with Competitive Advantage.
Personal Responsibility
By using the Website and Resources, you acknowledge that you are responsible for your own decisions, actions, participation, and implementation of information or strategies presented through the Website or Resources.
You agree to use reasonable judgment and, where appropriate, seek individualized guidance from qualified professionals before acting upon information provided through the Website or Resources.
No Guarantee of Results
Competitive Advantage does not guarantee any particular result from use of the Website, Resources, products, coaching, consultations, or services.
Individual results vary based on numerous factors, including an individual’s circumstances, participation, effort, training environment, physical and mental factors, and other circumstances beyond the control or knowledge of Competitive Advantage.
Prior results experienced by clients or customers do not guarantee that you or another individual will achieve the same or similar results.
Testimonials
The Website may include testimonials from clients or customers regarding Competitive Advantage products or services. Testimonials reflect the experiences of the individuals providing them and are presented truthfully to the best of our knowledge.
Results described in testimonials are not necessarily typical and do not guarantee that you or anyone else will achieve the same or similar results through use of our products, Resources, or services.
If a testimonial has been provided in exchange for a material benefit or incentive requiring disclosure, that relationship will be disclosed as appropriate.
Email Communications and Quizzes
Certain Resources, including quizzes, assessments, results, downloads, or other content, may require you to provide an email address.
Where disclosed at the time information is collected, providing your email address will also subscribe you to communications from Competitive Advantage. These communications may include mental performance tips, educational information, resources, company news, products, services, promotions, and other relevant updates.
You may unsubscribe from marketing emails at any time using the unsubscribe link included in those communications.
Certain transactional or service-related communications, such as purchase confirmations or communications relating to services you have requested, may still be sent when necessary.
Use of Purchased, Downloadable and Digital Content and Resources
Competitive Advantage may make Resources available for purchase, download, access, or use, including physical products, digital products, and free Resources made available in exchange for an email address.
Unless otherwise expressly stated, digital and downloadable Resources are provided under a limited, personal, non-exclusive, non-transferable, revocable license for your own individual use.
Purchase of a physical Resource, such as a book, gives you ownership of that individual physical copy but does not transfer any copyright, intellectual property rights, or rights to reproduce, copy, distribute, or commercially exploit the content contained within it.
You may not copy, reproduce, modify, publish, distribute, transmit, sell or resell copies, sublicense, create derivative works from, or otherwise commercially exploit any Resource or its content without prior written permission from Competitive Advantage, except as otherwise permitted by applicable law.
Purchasing or accessing a Resource does not transfer ownership of the underlying intellectual property to you.
Purchases and Payments
Products and services available through the Website may be offered for purchase through our ecommerce platform.
We currently use WooCommerce to facilitate online purchases and third-party payment processors, which may include Authorize.Net and PayPal, to process payments.
Payment information submitted to third-party payment processors is also governed by the terms and privacy practices of those providers.
Prices, products, services, features, and availability are subject to change without notice.
Shipping
Competitive Advantage ships eligible physical products within the United States using the United States Postal Service (USPS).
Customers may select from available shipping options at checkout, which may include USPS Media Mail, Ground Advantage, Priority Mail, or Priority Mail Express, depending on the product and destination. Shipping costs are calculated based on the selected shipping method.
Shipping and delivery times are estimates and may vary based on carrier delays, product availability, holidays, weather, or other circumstances outside our control.
Digital products and downloadable resources do not require shipping and are delivered electronically as described at the time of purchase.

Returns and Refunds
We want you to be satisfied with your purchase. If you experience a problem with an order or are unhappy with a product you purchased from Competitive Advantage, please contact us so we can work with you to find an appropriate solution.
Refunds, returns, or replacements may be offered when appropriate based on the circumstances of the purchase.
Because digital products and downloadable resources can be accessed immediately after purchase, refund requests for digital products will be considered on a case-by-case basis.
Nothing in this policy limits any rights you may have under applicable law.
Intellectual Property
The Website and its content contain intellectual property owned by or licensed to Competitive Advantage and/or Somasynthesis Studios Inc., including trademarks, service marks, copyrights, proprietary information, text, graphics, photographs, audio, video, designs, logos, quizzes, assessments, exercises, worksheets, downloads, training materials, methods, product and service names, slogans, and other content (“Intellectual Property”).

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Competitive Advantage concerning your use of the Website.
Separate agreements governing coaching, consultations, workshops, programs, or other services are governed by the terms of those agreements. If a separate written agreement expressly conflicts with these Terms with respect to the services governed by that agreement, the separate agreement will control with respect to those services.
Any waiver of a breach of or right under these Terms will not constitute a waiver of another or subsequent breach or right. No waiver shall be binding unless made in writing.
Governing Law; Jurisdiction
These Terms, together with the Privacy Policy, shall be construed in accordance with, and governed by, the laws of the Commonwealth of Massachusetts, and the courts of Massachusetts shall have jurisdiction to hear and determine any dispute arising in relation to these Terms. You agree that any proceeding relating to use of this Website must be filed exclusively in the appropriate courts located in Hampshire County, Massachusetts, and you submit to the jurisdiction of those courts and waive any objection based on an inconvenient forum or other reasons.
